Capacity development for the Ministry of Law

Indonesia’s legal system is largely based on the Dutch system and, as such, the Netherlands has much to offer in terms of advisory and technical assistance.

The Netherlands provides funding to the legal sector through a so-called facility fund, managed by the IMF, that focuses on strengthening national legal institutions, by supporting:

  • constitutional, bureaucratic and planning reforms of the judiciary;
  • capacity building of the judiciary, including the development of training curricula;
  • the establishment of a legal system survey to assess the national legal institutions. 

In addition, World Bank and UNDP support of the facility fund combines research, analytical and operational work to assist the Government of Indonesia (GoI) to produce a comprehensive National Strategy on Access to Justice.

  • In February 2009, the Indonesian Ministry of Law and Human Rights signed an MoU with the Dutch Ministry of Justice encompassing legal cooperation in the fields of:
  • legal drafting
  • human rights
  • migration management
  • penitentiary system management
  • human resources management
  • law library management and publication of legislation

The MoU targets direct assistance to the Ministry of Law and Human Rights while its agency for the development of human resources training also requires upgrading.

The NICHE programme will strengthen their capacity to teach legal drafting. Assistance may be extended over time to include other subjects mentioned in the MoU. The NICHE programme further builds on the capacities that have been developed during NPT projects on law in Aceh and on Bali.
